GENERAL TERMS AND CONDITIONS
Please read the following carefully and accept our terms and conditions before proceeding with any online payment or registration. The use of the masculine form in these terms and conditions is generic and refers to both men and women.
1. Purpose
Pilates Power Club offers personal physical training services in the form of private, semi-private sessions and private programmes (Barre-Pilates, Matwork, Stretch & Roll classes) which the customer agrees to pay for at the rate in force at the time of payment.
2. Registration and booking procedures
Registration for the Balance, Tonic and Excellence programmes is mandatory and is carried out using the specific ‘Private Programmes’ form available on the Register page of the Pilates Power Club website. The client agrees to answer all the questions on the form accurately, providing information that is as close to reality as possible. Once the registration form has been submitted, a face-to-face meeting will be organised between Pilates Power Club and the client. This meeting will allow us to review the client's expectations and adapt the programme to their specific needs, which may differ from the initial wishes expressed on the form. Pilates Power Club reserves the right to refuse any service if the client's objectives, such as significant weight loss or other reasons not compatible with the values and philosophy of Pilates Power Club, are identified during the interview. Registration will be confirmed after signing a contract tailored to the client's specific needs and after receipt of full payment or the first monthly instalment.
Registration for private sessions, semi-private sessions and 10-session packs is also mandatory and must also be made using the relevant forms on the Pilates Power Club website, available on the Register page. No registration will be validated without prior confirmation of payment and the written (email, WhatsApp, message) or oral (telephone, face-to-face) agreement of Pilates Power Club, represented by Ms Audrey de Visscher, concerning the time and day agreed between the client and her.
For semi-private sessions, only one person may register, but this person must provide full details of the second person.
3. Terms of payment and pricing policy
Classes can be purchased as a single session (private or semi-private), as a pack of 10 sessions or as a programme (Balance, Tonic and Excellence). All private and semi-private sessions, as well as programmes, must be paid for in advance, except for promotional offers or specific events.
Payments for private, semi-private and 10-session packs are made via the online payment service on the Pilates Power Club website. Payments for programmes (Balance, Tonic and Excellence) are made by bank transfer or cash and must be paid in full before the start of the first session OR by monthly instalments, payable before the 1st of each month.
Prices are indicative and Pilates Power Club reserves the right to change them without notice. In the event of a price increase, the customer will continue to benefit from the price in force at the time of payment until the corresponding credit is used up. Registrations are honoured in the order in which they are received.
All payments are non-refundable, unless otherwise stated in these GTC.
4. Cancellation and postponement policy for private and semi-private sessions
In the event of cancellation or postponement of a private or semi-private session less than 48 hours in advance, the session will be forfeited and billed in full, unless a medical certificate is presented. Private or semi-private sessions purchased are refundable in full only on presentation of a medical certificate. Refunds will be processed within a minimum of 30 days of validation of the request and supporting documents.
5. Validity and extension policy for Pack of 10 private sessions
Packs of 10 sessions are valid for 3 months from the date of purchase. If a 10-session pack is not used before the end of this period, the remaining balance is acquired by Pilates Power Club.
For packs of 10 sessions, an extension of validity beyond the initial 3 months will only be granted on presentation of a medical certificate attesting to the temporary inability to follow the sessions. The medical certificate must be presented before the end of the 3-month validity period in order to obtain an extension. This extension will allow sessions to be resumed when the customer is able to do so. If, at the end of the extension period, the remaining sessions are not used, the balance will be definitively acquired by Pilates Power Club, with no possibility of reimbursement or further postponement.
The 10-session pack is non-refundable, except in the event of prolonged or permanent physical incapacity, justified by a medical certificate. In the event of a refund, sessions already completed will be deducted from the total amount. Refunds will be processed within a minimum of 30 days of validation of the request and supporting documents.
6. Suspension, Termination and Change Policy for Private Programmes (Balance, Tonic and Excellence)
Long-term commitments (of 2, 3, 6, 12 months or more) for private programmes may be temporarily suspended for health reasons, subject to presentation of medical proof. If the customer is unable to resume training due to a serious medical condition, a partial refund will be given, after deduction of sessions already completed.
In the event of early termination for non-medical or non-valid reasons, such as moving house or any other non-health-related reason, the customer must provide 30 days' written notice and will be liable for 50% of the total amount outstanding under the contract. If the cancellation is for a valid medical reason, this 50% penalty will not apply, but sessions already completed will be deducted from the refund.
Without a valid medical certificate, no suspension or termination for health reasons will be accepted.
Change of programme : The client may change programme at any time after discussion with Pilates Power Club. A new contract will have to be signed, and the payment terms or the amount to be paid will be readjusted according to the new programme chosen.
7. Customer health information
It is the client's responsibility to seek medical advice before starting any training programme with Pilates Power Club. The offered programme is not intended to be medical in any way and presents risks inherent in any physical activity, which may be aggravated by pre-existing medical conditions.
The customer commits to :

Attend sessions at their own risk.

To inform Pilates Power Club of any health problems (heart, respiratory, joint, etc.) before starting the programme.

To report any change in their state of health during their commitment.

Stop immediately in the event of pain, shortness of breath, discomfort or any other symptom and inform the teacher, Ms Audrey De Visscher.
Pregnant women: It is the responsibility of pregnant women to consult their doctor to determine whether they can follow Pilates Power Club classes and to follow this assessment throughout their pregnancy.
Pilates Power Club cannot be held responsible if the client does not respect these obligations. Pilates Power Club and Mrs Audrey De Visscher cannot be held responsible for any injuries sustained during the sessions, except in the case of proven negligence.
8. Rules of conduct
Customers are required to comply with the following rules:

Arrive on time for each session.

Respect the teacher, Mrs Audrey De Visscher, the other participants and the equipment used during the lessons.
Sanctions in the event of failure to comply with the rules of conduct: Pilates Power Club customers are required to comply with the rules of conduct stipulated in these GTC.
Pilates Power Club reserves the right to apply the following sanctions in the event of failure to comply with the rules of punctuality, respect for other participants or equipment:
1. First offence: verbal or written warning.
2. Repeat or serious offence: Temporary suspension from the programme or access to sessions for a period determined by Pilates Power Club, with no possibility of reimbursement for sessions not completed during this period.
3. Serious breaches or repeated offences: permanent exclusion from the programme or from access to sessions, with no refund for remaining sessions.
Any decision will be made by Pilates Power Club at its discretion, depending on the severity of the offence and the impact on the smooth running of the sessions.
9. Electronic communications
Registrations, payments and bookings must be made online via the www.pilatespowerclub.ch website. Electronic communications exchanged via this system are secure, but Pilates Power Club cannot guarantee that there is no risk of interception by third parties. By continuing with their registration, customers accept this risk.
10. Liability
Pilates Power Club disclaims all liability to the fullest extent permitted by law, except in the case of damage caused by intent or serious negligence.
11. Right of publicity and use of audiovisual material
As part of the sessions and programmes offered by Pilates Power Club, photos and videos may be taken for promotional purposes (website, social media, advertising, etc.). These images may only be used with the prior written consent of the client. A document consenting to the use of the images will be presented for signature when the initial contract is concluded. The customer may choose to give or refuse this consent without any impact on their access to the services. If consent is given, the customer acknowledges that the images may be used for an unlimited period of time and in any medium chosen by Pilates Power Club. The customer may withdraw consent in writing at any time, which will not affect images already used prior to such withdrawal.
12. Data protection
Customers' personal data (registrations, payments, etc.) are treated confidentially, in accordance with our privacy policy.
13. Amendments to the GTC
In the event of a change to these GTC, customers will be informed by email. The new conditions will come into force immediately after notification, without any possibility of refusal or disagreement on the part of the customer.
